The Cabinet of Ministers of Ukraine adopted the decree "On Approval of the Plan of Measures to Improve the Mechanism of State Assistance to Economic Entities," developed by the Antimonopoly Committee of Ukraine. This document was developed to replace the "Plan of Measures to Conduct Institutional Reform in the Field of Monitoring and Control of State Assistance to Business Entities and Implementation of the Provisions of the Law of Ukraine "On State Assistance to Business Entities", approved by the Cabinet of Ministers in 2013. The vast majority of activities under this plan have already been implemented.
The adoption of the new plan will ensure the implementation of the provisions of the Association Agreement between Ukraine and the EU and facilitate compliance with the principle of legal certainty in the implementation of the powers of the Antimonopoly Committee of Ukraine provided for by the legislation in the field of state aid.
Thus, the new Plan defines measures for improvement of the regulatory framework:
- development of criteria for assessing the admissibility of state aid to business entities;
- bringing normative legal acts on state aid granted to business entities recognized inadmissible by the Committee's decision in compliance with the Law of Ukraine "On State Aid to Business Entities
- carrying out monitoring and control of state aid to business entities; organizational and technical support for monitoring state aid to business entities.
As well as measures to stimulate state aid grantors to comply with the requirements of the legislation in the sphere of state aid. Recall that under Article 267 of the Association Agreement between Ukraine and the EU in December 2022 the transitional period of preparation of the national legislation to the requirements of the legal system of the European Union ends.
Hence the need to eliminate the gaps remaining in the practical application of European norms and rules for granting, monitoring and controlling state aid in Ukraine.
